1月17日，最高人民法院發(fā)布關(guān)于審理涉及夫妻債務(wù)糾紛案件適用法律有關(guān)問題的解釋，就當(dāng)前司法實(shí)踐中爭議較大的夫妻共同債務(wù)認(rèn)定問題作出明確規(guī)定，并合理分配舉證證明責(zé)任，平衡保護(hù)各方當(dāng)事人合法權(quán)益。

The Supreme People's Court issued a judicial interpretation on the Marriage Law on Wednesday, clarifying the division of debt.

最高人民法院17日發(fā)布《婚姻法》有關(guān)司法解釋，對債務(wù)分配作出明確規(guī)定。

該司法解釋明確規(guī)定，夫妻雙方共同簽字或者夫妻一方事后追認(rèn)等共同意思表示所負(fù)的債務(wù)（debts incurred by both the husband and the wife or acknowledged by a spouse thereafter），應(yīng)當(dāng)認(rèn)定為夫妻共同債務(wù)（joint debts）。

夫妻一方在婚姻關(guān)系存續(xù)期間以個(gè)人名義為家庭日常生活需要所負(fù)的債務(wù)（debts incurred by a spouse for the family's daily needs during a marriage），債權(quán)人以屬于夫妻共同債務(wù)為由主張權(quán)利的，人民法院應(yīng)予支持。

夫妻一方在婚姻關(guān)系存續(xù)期間以個(gè)人名義超出家庭日常生活需要所負(fù)的債務(wù)（debts incurred by a spouse for use beyond the scope of the family's daily needs），債權(quán)人以屬于夫妻共同債務(wù)為由主張權(quán)利的，人民法院不予支持，但債權(quán)人能夠證明該債務(wù)用于夫妻共同生活、共同生產(chǎn)經(jīng)營或者基于夫妻雙方共同意思表示的除外（unless the creditor can prove the debt has been used for the family, common production or business or incurred with mutual consent）。

該司法解釋于2024年1月18日起正式實(shí)施。
